1. Agreeing to these Terms
By creating an Atlas account or using the app, you agree to these Terms and to the Atlas Privacy Policy, which explains what data we collect and how we handle it. Because Atlas stores information about your child, please also read our Children's Privacy Notice before you sign up. If you do not agree, do not use Atlas.
The app records the version of these Terms you accepted. These Terms govern your use of the Atlas application. Nira's website and clinical program are governed by their own terms, available at nira-health.com; if those documents and these Terms ever differ about the Atlas app, these Terms control for the app.
2. What Atlas is — and what it is not
Atlas is a tool that helps a parent or guardian track and understand a child's behavioral patterns — sleep, mood, cooperation, focus, and connection. You can log daily check-ins and events, see a computed wellbeing score and detected patterns, and chat with Audrey, an automated AI assistant.
Atlas is not medical care. Please read this carefully:
- Atlas and Audrey are not a medical device, not a diagnostic tool, and not a substitute for professional medical, psychological, or psychiatric care.
- Nothing in the app is medical advice, diagnosis, or treatment. The wellbeing score and insights describe the information you entered — they do not screen for, detect, or diagnose any condition.
- Audrey is an automated assistant. No live person monitors Audrey conversations in real time.
- Using Atlas does not create a clinician–patient relationship with anyone.
- Always consult a qualified clinician about your child's health.
In an emergency, call 911. For a mental-health crisis, call or text 988 (Suicide & Crisis Lifeline). Atlas cannot help in an emergency.
3. Who can use Atlas
- You must be at least 18 years old and the parent or legal guardian of every child you add to Atlas, with the authority to consent to the collection of that child's information.
- One account represents one household. Add only children in your own household, and only children you are the parent or legal guardian of.
- Atlas is not for use by children. Children do not have accounts and must not use the app on their own behalf.
- Atlas is offered for users in the United States.
4. Your account
You are responsible for the accuracy of the information you provide, for keeping your login credentials safe, and for all activity under your account. If you believe someone has used your account without permission, email support@nira-health.com right away.
5. Audrey, the AI assistant
Audrey is built on a large language model. That means:
- Audrey can make mistakes. Its responses are automated, general information — they may be inaccurate, incomplete, or out of date, and they are never professional advice. Verify anything important, and talk to a clinician before making medical decisions.
- Audrey will not give medication or supplement doses or changes. Those decisions belong with your child's clinician.
- No one is watching the conversation. Audrey cannot recognize or respond to every emergency. If you or your child are in crisis, call 911 or call/text 988 — do not rely on the app.
- Your conversations with Audrey are processed by our AI service provider to generate responses, as described in the Atlas Privacy Policy.
- We may suspend or disable Audrey at any time, for example for safety or maintenance reasons.
6. Booking a discovery call
Audrey or the app may offer you the option to book a free discovery call with Nira Health. Booking is optional and is scheduling only — it is handled by Cal.com, a third-party scheduling service, in your browser outside the app. Anything you enter on the booking page (such as your name and email) is governed by Cal.com's privacy policy. Booking a call does not enroll you in any program and does not create a clinician–patient relationship.
7. Atlas and Nira Health's clinical program
Atlas app data is consumer health information governed by these Terms and the Atlas Privacy Policy — it is not a clinical or medical record. Nira Health's clinical program is a separate service, delivered by licensed providers under its own agreements. If your family later enrolls in the clinical program, your clinical records are governed by the clinic's Notice of Privacy Practices, available at nira-health.com/privacy.html. Families enrolled in the clinical program may see additional features inside Atlas (such as messaging and scheduling with their care team); those services are provided under the clinical program's separate terms.
8. Subscriptions and billing
Atlas has a free tier. Paid features are sold as an auto-renewing subscription through Apple In-App Purchase:

- Payment is charged to your Apple ID at confirmation of purchase.
- Auto-renewal: your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Renewal is charged within 24 hours before the period ends.
- Managing and cancelling: you manage and cancel the subscription in your Apple ID account settings (Settings → your name → Subscriptions on your device). Cancelling stops future renewals; you keep paid access until the end of the period already paid for.
- Price changes: if we change the price, we will notify you in advance, and the change will apply no earlier than your next renewal. Where Apple requires it, you will be asked to agree before a higher price takes effect.
- Refunds: purchases made through Apple are subject to Apple's refund process — request a refund at reportaproblem.apple.com. We cannot issue refunds for Apple In-App Purchases ourselves.
- Deleting your account does not cancel your subscription. If you delete your Atlas account, also cancel the subscription in your Apple ID settings, or Apple will keep billing you.
Beta pricing. During the beta period, we may provide paid features free of charge ("beta comp") at our discretion. Beta comp is not a purchase, carries no renewal obligation, and may end when Atlas becomes generally available or earlier; we will let you know before it ends.
9. Beta program
While Atlas is in beta (including distribution through Apple's TestFlight):
- Atlas is a work in progress. Features may change, break, or be removed, and availability is not guaranteed.
- TestFlight builds expire and are also governed by Apple's TestFlight terms.
- If you send us feedback, ideas, or suggestions, you give us the right to use them without obligation or compensation — that's the point of a beta, and we appreciate it.
- We may end the beta program, or any participant's access to it, at any time.
10. Acceptable use
You agree not to:
- add or track a child you are not the parent or legal guardian of, or enter another person's information without authority;
- share your account or use someone else's;
- use Atlas for any unlawful purpose, or in a way that could harm a child;
- probe, disrupt, overload, or interfere with the service, or access it by any means other than the app's interfaces;
- reverse-engineer, scrape, copy, or resell the service or its content;
- attempt to manipulate, jailbreak, or misrepresent Audrey's outputs, or pass off Audrey's responses as professional advice;
- use the service to build a competing product or to train a machine-learning model.
We may suspend or terminate accounts that violate this section.
11. Your data
You own the information you and your household enter into Atlas. You give us a limited license to host, process, and display that information to operate and improve the service for you — including generating your wellbeing score, insights, and Audrey's responses — as described in the Atlas Privacy Policy. We do not sell your data or your child's data.
Account deletion. You can delete your account in the app at any time (Profile → delete account). When you do:
- your household's data, including all child data, is deleted from our live systems immediately;
- any uploaded files are deleted immediately and are unrecoverable;
- residual copies in our encrypted backups are purged within 7 days;
- we keep a minimal record that the deletion occurred (not the deleted content).
Data previously processed by our service providers (for example, to generate an Audrey response) is handled and deleted under the timelines described in the Atlas Privacy Policy.
12. Intellectual property
Atlas, including its software, design, content, and trademarks, is owned by Nira, LLC or its licensors. We grant you a personal, non-exclusive, non-transferable license to use the app on Apple-branded devices you own or control, as permitted by the App Store terms. Except for that license and your own data, no rights are transferred to you.
13. Termination
You may stop using Atlas at any time and may delete your account in-app (see Section 11). We may suspend or terminate your access if you breach these Terms, if we reasonably believe your use creates risk or legal exposure, or if we discontinue the service; where practical, we will give you notice. Termination does not by itself cancel an Apple subscription (see Section 8). Sections that by their nature should survive — including Sections 11 (your data), 14 (disclaimers), 15 (limitation of liability), and 16 (disputes) — survive termination.
14. Disclaimers
Atlas is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted or error-free, that the wellbeing score or insights are accurate or complete, or that Audrey's responses are correct. This section works together with Section 2: nothing in Atlas is medical advice, and you should not make health decisions based on the app alone.
Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
15. Limitation of liability
To the maximum extent permitted by law:
- we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data;
- our total liability for all claims relating to Atlas is limited to the greater of (a) the amounts you paid us for Atlas in the 12 months before the claim or (b) $100.
Nothing in these Terms limits liability that cannot be limited by law — including, where applicable, liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence — and nothing limits any non-waivable consumer rights you have under the law of your state.
16. Disputes, arbitration, and governing law
Please read this section carefully. It affects your rights, including your right to sue in court and to participate in a class action. You can opt out — see below.
Governing law. These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules.
Talk to us first. Before starting any formal proceeding, email support@nira-health.com with a written description of your dispute and give us 30 days to try to resolve it in good faith.
Arbitration. If we cannot resolve it informally, you and Nira agree that any dispute arising out of or relating to Atlas or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be held in Nashville, Tennessee, or, under the AAA consumer rules, by video, phone, or written submissions if that is more convenient for you. The AAA consumer rules cap your filing fees; we will pay arbitration costs as those rules require.
Small-claims carve-out. Either of us may instead bring an individual claim in small claims court if it qualifies there.
Class-action waiver. You and Nira each waive the right to participate in a class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Emergency relief. Either party may ask a court for emergency injunctive or equitable relief to prevent irreparable harm pending arbitration.
Your right to opt out. You may opt out of this arbitration agreement and class-action waiver, with no effect on your ability to use Atlas, by emailing support@nira-health.com within 30 days of first accepting these Terms. Include your name, your account email, and a statement that you opt out of arbitration.
If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) proceeds in court rather than arbitration; the rest of this section still applies.
17. Changes to these Terms
We may update these Terms as Atlas evolves. When we do, we will change the effective date and version string above, and the app will prompt you to review and accept the new version before you continue — the app records which version you accepted. For material changes to how we collect, use, or disclose children's data, continued use is not treated as acceptance: we will ask for your renewed consent as described in the Children's Privacy Notice. If you do not accept updated Terms, stop using Atlas and, if you wish, delete your account.
18. Apple
These Terms are between you and Nira, LLC — not Apple. Apple is not a party to these Terms, has no obligation to provide maintenance or support for Atlas, and is not responsible for the app, its content, or any claims relating to it (including product-liability, regulatory, or intellectual-property claims). Your download and use of Atlas are also subject to the Apple Media Services Terms and the App Store's standard Licensed Application End User License Agreement. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
19. General
- Severability: if any part of these Terms is found unenforceable, the rest remains in effect.
- Entire agreement: these Terms, the Atlas Privacy Policy, and the Children's Privacy Notice are the entire agreement between you and Nira about the Atlas app.
- Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, with notice to you.
- No waiver: if we don't enforce a provision, we are not waiving it.
